Gamache & Myers, P.C. (“Gamache & Myers”, “we”, “us” or “our”) believes it is a good business practice to disclose to you how your personal information and activity on our website is utilized. As a user of our website, and it's subpages and content (collectively, the “Site”) or our services or products (collectively, “Service(s)”), this Privacy Policy is intended to describe in a straight-forward and easily understandable manner:

Debt Collection Notice


We are a debt collector. Any and all information you provide to us may be used to aid in our collection of debts. Accordingly, this and all other communications are from a debt collector in an attempt to collect a debt. Any information obtained will be used for that purpose.

We collect information about you so we can continue to provide and improve our Services to you and other users of the Site. We may obtain personal and non-personal information about you from third-party sources, including our clients. This information may be utilized, analyzed, and/or compared with information that we have collected from you or that you have submitted to the Site. If the third-parties unlawfully obtained and/or provided the information to us you acknowledge and agree that your sole legal remedy is against the third-party that engaged in the unlawful activity.


We also utilize the services of one or more third-parties, including Amazon Web Services (“AWS”) and financial institutions who may process payments. When utilizing such third-party services, their privacy policies and practices will govern the handling of your data.


Information Collection Technology (Web Beacons and Cookies)


Our website currently does not utilize cookies, web beacons, or similar tracking devices.

Personal Information About Users Under 18 Years of Age Not Collected


The Site is meant for adults and those who have reached the age of majority as defined by the laws of their domicile. This Site is not meant for individuals under the age of 18 or those defined by the laws of their domicile as minors. Individuals under the age of 18 are not authorized to use this Site.



Information Use and Sharing


We may use and share your information with our clients, and as may we deem reasonable, to public or private third-parties: (i) for inspection by law enforcement officials (including in the case of potential criminal activity); (ii) to respond to cease and desist letters, arbitration proceedings, legal actions and suits, criminal and civil subpoenas, any court orders; (iii) to enforce or apply the terms of this Privacy Policy or any other agreement between us; (iv) in connection with the collection of any debt owed to a client of the firm, and (v) to protect the rights, property, or safety of ours, our users, or others, whether during or after the term of your use of our Services.

Legal Process and Investigation Issues


From time to time, Gamache & Myers may be required to respond to a subpoena or similar investigative demand from law enforcement, a court order, a government agency, or a private litigant. Gamache & Myers reserves all rights to defend, within its sole discretion, against such legal requests, demands, and claims. For instance, Gamache & Myers may raise or waive legal objections or rights. Gamache & Myers also reserves the right to disclose your information, as allowed by applicable law, when we believe it is reasonably appropriate based on the situation. Such disclosure may occur, but is not limited to, disclosing your information in connection with efforts to: investigate, prevent, or commence other actions regarding suspected illegal activity or other wrongdoing; to protect, defend the rights, property or safety of our company, our users, our employees, or others; comply with applicable law or cooperate with law enforcement; or enforce our Site Terms of Service or other agreements or policies.


Notice about Social Security Numbers


We generally do not collect social security numbers; however, if we come into possession of users’ social security numbers or collects such information in the future, the information will be treated confidentially and will only be shared with our clients (i.e. your creditors) unless otherwise allowed by law or as reasonably necessary to pursue collection litigation or in pursuit of a post judgment remedy. Additionally, Gamache & Myers will take reasonable steps to limit the access to the social security numbers and take legally required steps of securing the transmission of the data.


Notice about the use of your telephone number


If you provide us with a contact telephone number on this site, you authorize us to contact you at the number provided. Also, you authorize us to leave a voice mail message that includes but is not limited exclusively to the following: the caller’s name, our firm name, a call back number and a statement that we are a debt collector.


Third Party Privacy Policies May Be Applicable


Our Privacy Policy does not cover any third party’s use or handling of your information once it is shared. Instead, the privacy policies of the third party(ies) will govern. We encourage you to visit the websites of those third-parties and fully read and understand their privacy policies. Some of these entities or their servers may be located outside the United States.



DO NOT TRACK REQUESTS


In some states, users may be entitled to know how we response to “Do Not Track” browser settings. Like many other websites and online services, we do not alter our practices because there is little consensus in the industry about what “Do Not Track” means.



Information Retention and Security


We may store your information for more than seven (7) years from the time of initial submission, as well as automated personal information we collect about you.


We take reasonable security measures to protect users’ information against unauthorized access, loss, alteration, or destruction. Despite these reasonable measures, we cannot guarantee our security measures are impenetrable. Terms of Privacy Policy Survive

Limitations


The adoption or publication of this Privacy Policy does not subject Gamache & Myers to any stricter duty in it's collection, handling, storage and disclosure of nonpublic information than otherwise applies to Gamache & Myers under applicable law. No person or entity shall have any right or recourse against Gamache & Myers it's affiliates, agents, sponsors, or other related parties based on any alleged violation or noncompliance with this Privacy Policy. This Policy is to be construed under the laws of the State of Missouri.


In certain situations, clients of Gamache & Myers may dictate how their personal information is used, stored, and processed. If you are a client, you may provide written instructions to Gamache & Myers about how you wish for your personal information to be treated.
